Terms & Conditions IBANA Colombia

Welcome to IBANA Colombia.

These Terms and Conditions govern the reservation, purchase, and use of tourism services, private journeys, experiences, and other services offered by IBANA COLOMBIA, operating under the commercial name IBANA Colombia, identified with NIT 1.088.283.665, Registro Nacional de Turismo (RNT) No. 206230, with registered address at CALLE 18 # 31 – 82, PEREIRA, RISARALDA, COLOMBIA.

By completing a reservation or purchasing a service from IBANA Colombia, the traveler or person making the reservation (“Traveler”, “Client” or “you”) confirms that they have had the opportunity to read these Terms and Conditions and expressly accept the conditions applicable to the purchased service.

These Terms and Conditions are governed by Colombian law, including the applicable provisions of the Colombian General Tourism Law, consumer protection regulations, electronic commerce regulations, personal data protection legislation, and any rules that amend, supplement, replace, or regulate them.

1. ABOUT IBANA COLOMBIA

IBANA Colombia is a tourism services provider that designs, organizes, coordinates, operates, and/or intermediates private journeys, excursions, transportation, accommodation, activities, guides, gastronomic experiences, and other tourism-related services in Colombia.

 

Depending on the itinerary, certain services may be provided directly by IBANA Colombia while others may be supplied by independent third-party providers such as hotels, transportation companies, airlines, restaurants, local guides, activity operators, cultural organizations, or other duly authorized tourism providers.

IBANA Colombia remains responsible for the services it is legally required to provide and for fulfilling the obligations assumed in the specific travel proposal or confirmed itinerary, subject to Colombian law and the conditions set forth herein.

2. TRAVEL PROPOSALS AND SERVICES

Every journey, experience, or tourism service may have its own specific conditions.

Before confirming a reservation, IBANA Colombia will provide the Traveler with relevant information regarding the services being offered, which may include:

·        Itinerary and duration;

·        Included services;

·        Services not included;

·        Accommodation, when applicable;

·        Transportation, when applicable;

·        Scheduled activities and experiences;

·        Applicable rates and taxes;

·        Payment schedule;

·        Cancellation and modification conditions;

·        Relevant restrictions or requirements; and

·        Any special conditions applicable to third-party services.

Only those services expressly stated as included in the confirmed proposal, itinerary, voucher, or booking confirmation shall form part of the purchased service.

Photographs, descriptions, maps, travel times, and other website content are intended to provide an accurate representation of the experiences offered. Certain details may vary due to seasonality, weather, availability, operational considerations, destination conditions, or other circumstances.

3. RESERVATIONS AND BOOKING CONFIRMATION

A request for information, quotation, or availability does not by itself constitute a confirmed reservation.

A reservation becomes confirmed when the conditions communicated by IBANA Colombia have been accepted and the required deposit or full payment has been successfully received, unless IBANA Colombia expressly confirms another arrangement in writing.

Upon confirmation, the Traveler will receive a written booking confirmation, travel proposal, itinerary, voucher, invoice, or other document identifying the services purchased.

When one person makes a reservation on behalf of other travelers, that person confirms that they are authorized to provide the necessary booking information and to communicate the applicable travel conditions to the members of their party.

4. PRICES

Prices will be communicated in the currency indicated in the corresponding quotation or booking process.

Before payment, IBANA Colombia will inform the Traveler of the total price of the contracted services and any taxes, fees, charges, or additional costs payable to IBANA Colombia that can reasonably be determined at that time.

Certain expenses payable directly by the Traveler at the destination —such as personal expenses, optional services, gratuities, or charges expressly identified as not included— are excluded unless otherwise stated.

Prices and availability may change before a reservation is confirmed. Once a booking has been confirmed, the agreed price will be respected except where a modification is required by law, requested by the Traveler, or results from an expressly disclosed variable charge that could not reasonably have been determined at the time of confirmation.

If an obvious pricing or publication error is identified before the service is provided, IBANA Colombia will notify the Traveler as soon as reasonably possible and propose the alternatives available under applicable law.

5. PAYMENTS AND DEPOSITS

Unless different conditions are established in the specific travel proposal:

1.     A deposit of 15% of the total booking value may be required to confirm the reservation.

2.     The balance must be paid according to the deadline stated in the quotation or booking confirmation.

3.     The Traveler may elect to pay 100% of the booking value at the time of confirmation.

4.     Reservations that require immediate payments to hotels, transportation providers, airlines, activity providers, event organizers, or other third parties may be subject to additional or different payment and cancellation conditions, which will be communicated before confirmation whenever applicable.

Failure to complete payment within the agreed period may result in cancellation of the reservation after IBANA Colombia has informed the Traveler of the outstanding payment, subject to the specific booking conditions and applicable law.

IBANA Colombia will never request payment to an account or payment method other than one officially communicated through its authorized channels. Travelers are encouraged to verify any unexpected request for payment directly with IBANA Colombia.

 

6. CANCELLATIONS BY THE TRAVELER

Cancellation conditions depend on the type of journey, the date of cancellation, and the conditions imposed by the providers involved in the reservation.

The specific cancellation conditions applicable to a journey will be communicated to the Traveler before the booking is confirmed.

Where a 15% booking deposit has been expressly agreed as non-refundable, IBANA Colombia may retain that deposit in the circumstances permitted by Colombian law and subject to any mandatory consumer rights that may apply.

Additional amounts may be non-refundable when IBANA Colombia has already incurred charges or non-refundable commitments with third-party providers, provided those conditions were communicated to the Traveler as applicable to the reservation.

Nothing in this section limits any mandatory right granted to the Traveler by Colombian consumer protection legislation.

 

7. RIGHT OF WITHDRAWAL FOR DISTANCE AND ELECTRONIC SALES

When the legal requirements for the Colombian consumer right of withdrawal (derecho de retracto) are met, the Traveler may exercise that right within the period established by applicable law.

The right of withdrawal is subject to the statutory requirements and exceptions applicable to the particular transaction, including circumstances where the provision of the service has already begun with the Traveler's agreement or where another legal exception applies.

 

When the right of withdrawal legally applies and is validly exercised, IBANA Colombia will process the reimbursement in accordance with the deadlines and requirements established by Colombian law, without applying contractual cancellation penalties that are legally incompatible with that right.

The request should contain sufficient information to identify the Traveler and the corresponding reservation.

8. UNUSED SERVICES AND NO-SHOWS

If a Traveler voluntarily fails to appear for or use a confirmed tourism service, the corresponding refund, retention, or penalty will be determined in accordance with the specific booking conditions, the conditions of the suppliers involved, and applicable Colombian tourism and consumer protection law.

Services voluntarily abandoned, interrupted, or unused after the journey has begun will not automatically generate a right to reimbursement.

IBANA Colombia will inform the Traveler of any amounts that may be recoverable from the corresponding service providers.

 

9. CHANGES REQUESTED BY THE TRAVELER

Any request to modify dates, names, accommodation, transportation, activities, or other elements of a confirmed reservation will be subject to availability and to the conditions of IBANA Colombia and the relevant service providers.

Additional costs resulting from a Traveler-requested modification must be approved before the change is confirmed.

Some tickets, reservations, activities, special events, or promotional rates may not permit changes or refunds. Any such restrictions known to IBANA Colombia will be communicated before purchase.

10. CHANGES OR CANCELLATIONS BY IBANA COLOMBIA

IBANA Colombia may make reasonable changes to an itinerary when necessary because of circumstances such as weather, safety conditions, road closures, transportation disruptions, availability, force majeure, instructions from authorities, or other operational circumstances that materially affect the planned service.

Whenever reasonably possible, IBANA Colombia will seek to preserve the nature and quality of the confirmed journey and may substitute accommodation, transportation, activities, or other services with alternatives of comparable characteristics.

If IBANA Colombia is unable to provide a contracted service for reasons attributable to IBANA Colombia, the Traveler will have the rights provided by applicable Colombian law, which may include the provision of an equivalent service or the corresponding reimbursement or compensation for the unfulfilled service.

11. FORCE MAJEURE AND EVENTS BEYOND REASONABLE CONTROL

Neither IBANA Colombia nor the Traveler will be considered in breach of an obligation to the extent that performance is prevented by a duly established event of force majeure or unforeseeable event under Colombian law.

Such events may include, depending on the circumstances, severe weather conditions, natural disasters, earthquakes, landslides, road closures, public disturbances, strikes, epidemics or public-health emergencies, governmental restrictions, security situations, or other events beyond the reasonable control of the affected party.

Where such an event affects a journey, IBANA Colombia may modify, postpone, substitute, or cancel affected services when reasonably necessary for operational or safety reasons.

Any reimbursement for unused services will be determined according to applicable law and the amounts that can be recovered from the corresponding providers, without prejudice to the Traveler's mandatory statutory rights.

12. THIRD-PARTY SERVICE PROVIDERS

IBANA Colombia may contract or coordinate services supplied by third parties.

Hotels, airlines, transportation companies, restaurants, guides, activity operators, and other providers may maintain their own operational, cancellation, safety, and booking conditions.

IBANA Colombia will inform the Traveler of material supplier restrictions that apply to the reservation when these are known and relevant.

Nothing in these Terms excludes or limits any responsibility that IBANA Colombia has under applicable Colombian law for the organization, intermediation, or provision of contracted tourism services.

13. AIR TRANSPORTATION

Unless otherwise expressly stated, scheduled commercial flights are operated by independent airlines and are governed by the corresponding contract of carriage and applicable aviation regulations.

Flight schedules, cancellations, delays, baggage conditions, reimbursements, and other matters directly related to air transportation are subject to the applicable aviation regulations and the airline's conditions.

When IBANA Colombia intermediates an airline reservation, it will communicate known restrictions relevant to changes, endorsements, or refunds.

14. TRAVEL DOCUMENTS, VISAS AND ENTRY REQUIREMENTS

IBANA Colombia may provide general guidance regarding documentation reasonably required for the journey.

However, each Traveler is responsible for holding a valid passport or identification document and for complying with applicable immigration, visa, health, vaccination, entry, and exit requirements.

Visa issuance, immigration decisions, and permission to enter or remain in a country are exclusively determined by the competent authorities.

Travelers are responsible for verifying requirements applicable to their nationality, personal circumstances, and itinerary before traveling.

 

15. HEALTH, SAFETY AND PARTICIPATION IN ACTIVITIES

Travelers should inform IBANA Colombia before the journey of any circumstance relevant to the safe and proper provision of a contracted activity, subject to applicable personal-data and privacy rules.

Some experiences may involve walking, hiking, altitude, uneven terrain, water activities, cycling, horseback riding, wildlife observation, or other activities requiring an appropriate level of physical ability.

IBANA Colombia will provide relevant information about significant known requirements or restrictions associated with an activity. Travelers remain responsible for assessing whether an activity is appropriate for their individual circumstances and following reasonable safety instructions provided by guides and operators.

IBANA Colombia may refuse or discontinue a Traveler's participation in an activity when their behavior creates a material and immediate risk to themselves, other participants, local communities, personnel, wildlife, or property, subject to applicable law.

16. LUGGAGE AND PERSONAL BELONGINGS

Travelers are responsible for the custody of their passports, travel documents, money, luggage, electronic equipment, jewelry, and other personal belongings.

IBANA Colombia will reasonably assist Travelers in reporting or addressing lost or damaged property when possible but will only be liable where responsibility is attributable to IBANA Colombia under applicable law.

Different baggage conditions may apply to airlines and transportation providers.

17. TRAVEL INSURANCE

IBANA Colombia recommends that Travelers obtain appropriate travel insurance according to the characteristics of their journey.

 

Depending on the Traveler and itinerary, appropriate coverage may include medical assistance, accidents, trip interruption or cancellation, baggage, evacuation, and other travel-related contingencies.

The purchase and scope of any voluntary insurance policy remains subject to the terms established by the corresponding insurer.

 

18. TRAVELER CONDUCT AND RESPECT FOR DESTINATIONS

IBANA Colombia promotes responsible and respectful travel.

Travelers are expected to respect local communities, cultural heritage, guides, service providers, other travelers, wildlife, protected areas, and applicable environmental and local regulations.

Illegal activities, harassment, discrimination, abuse, exploitation, or conduct that places people, animals, cultural heritage, or ecosystems at risk will not be tolerated.

19. PROTECTION OF CHILDREN AND ADOLESCENTS

IBANA Colombia is committed to the prevention of the sexual exploitation and abuse of children and adolescents in travel and tourism.

 

In accordance with Colombian legislation and the applicable tourism-sector Code of Conduct, IBANA Colombia rejects and works to prevent any form of sexual exploitation, abuse, trafficking, or commercial sexual exploitation of children and adolescents.

 

Any conduct that may constitute such an offense may be reported to the competent Colombian authorities.

20. PERSONAL DATA AND PRIVACY

IBANA Colombia processes personal data in accordance with Colombian personal data protection legislation and its Privacy and Personal Data Processing Policy.

Personal information may be processed when necessary to:

·        Respond to inquiries;

·        Prepare quotations;

·        Create and administer reservations;

·        Coordinate services with hotels, guides, transportation companies, insurers, activity operators, and other providers;

·        Comply with legal and administrative obligations;

·        Provide customer assistance; and

·        Carry out other purposes authorized by the data subject or permitted by law.

Where personal data must be shared with providers for the proper operation of a journey, IBANA Colombia will process such information according to applicable law and the corresponding privacy policy.

Marketing communications will be handled in accordance with the authorizations and rights established by applicable law.

21. WEBSITE AND ELECTRONIC TRANSACTIONS

IBANA Colombia seeks to keep the information displayed on its website accurate and current.

The website may occasionally contain typographical, technical, availability, or pricing errors. When a material error is identified, IBANA Colombia will correct it and, if it affects an existing transaction, inform the Traveler and apply the remedies required by applicable consumer law.

Before completing an electronic purchase, the Traveler will be given access to the relevant conditions of the transaction and an opportunity to review the services and total amount payable.

The website may contain links to independent third-party websites. IBANA Colombia does not control those websites, and their use is subject to the corresponding third party's terms and privacy practices.

22. INTELLECTUAL PROPERTY

Unless otherwise indicated, the texts, photographs, graphics, logos, designs, audiovisual content, itineraries, and other original materials published by IBANA Colombia are owned by IBANA Colombia or used with the corresponding authorization.

They may not be reproduced, commercially exploited, distributed, altered, or publicly used without prior authorization except as permitted by applicable law.

The IBANA Colombia name, logo, and other protected brand elements may not be used in a manner that falsely suggests authorization, endorsement, affiliation, or partnership.

23. PHOTOGRAPHS, REVIEWS AND USER CONTENT

Submitting a photograph, video, testimonial, or other content to IBANA Colombia does not automatically constitute authorization for unrestricted commercial use.

Where IBANA Colombia wishes to use identifiable Traveler-generated content for marketing or promotional purposes, the corresponding authorization will be obtained when required by applicable intellectual-property, image-rights, and personal-data regulations.

 

Reviews submitted voluntarily through platforms operated by third parties will additionally be governed by the terms of those platforms.

 

24. COMPLAINTS AND CUSTOMER SERVICE

If a problem occurs during a journey, Travelers are encouraged to inform IBANA Colombia as soon as reasonably possible so that the team can attempt to address the situation while the service is taking place.

IBANA Colombia will process consumer requests and claims in accordance with applicable Colombian legislation.

The availability of IBANA Colombia's internal customer-service channels does not limit the Traveler's right to contact or file a complaint with the competent Colombian authorities.

25. CONSUMER RIGHTS

Nothing in these Terms and Conditions shall be interpreted as a waiver, restriction, or exclusion of rights granted to consumers or tourists by mandatory Colombian law.

If any provision of these Terms conflicts with a mandatory legal provision, the applicable legal provision will prevail, while the remaining Terms will continue in effect to the extent legally permitted.

26. APPLICABLE LAW

These Terms and Conditions and the tourism services contracted with IBANA Colombia are governed by the laws of the Republic of Colombia.

Any dispute will be handled through the mechanisms and before the competent authorities or courts established by applicable Colombian law, without limiting any jurisdiction or protection that the law mandatorily grants to the consumer.
